June 28th1887.

The Board met pursuant to adjournment Present Regents Twamley, Heidel, Fulton, and President Roach. Minutes of the preceding meetings were read and approved.

The President of the Board presented the following report made to the Governor:

Sir:

It becomes our painful duty to inform you of the damage sustained by the University of North Dakota building in the wind storm which recurred here on the 16th inst.

The West wing in addition, built in 1884, at a cost of $1500000 is entirely demolished above the basement story, the south side being completely demolished, in this addition was our Museum containing many valuable and rare specimens which are almost entirely destroyed or carried away by the storm. The Main building seems to be intact as regards the walls, but the roof is broken in by the falling of the timbers chimneys. On the South side where the weight of the falling brick seems to have been the heaviest, there is quite a large fracture about twenty feet square the rafters are broken as also a few of the joists of the floor below, carrying with them the plastering and broken timbers. the weight of the falling mass cracking the plastering badly in several rooms. On the North side the roof is broken through in a smaller way, breaking the rafters but not the joists, however cracking the plastering of the ceilings in the lower rooms. The large ornamental Cupalo on the roof, is blown off, carrying with with [sic] it the floor underneath leaving a large aperture in the roof [written over floor]. Besides these the roof has sustained other injuries, by reason of the flying timbers and falling brick, displacing shingles

and breaking the sheathing.

The ornamental coping on the top of the front wall was blown off, carrying with it four or five courses of the brick work and this falling mass somewhat injured the stone steps and coping of the front approaches. We have put a force of men at work, removing the rubbish and closing up the apertures, to protact [sic] the building against further damage from the weather and [unreadable] estimates of the probable cost of repairing the building to submit the same to you for instructions as to our future action in the matter. Very Respectfully. W.N. Roach. Pres, and further reported that the Governor did not feel justified in authorizing the removal of the University without Legislat[-]ive Sanction as it would establish a dangerous precedent but that he would approve the repairing of the building and recommend that the University be reimbursed for any reasonable expenditure incurred therefore [sic].

Mr Twamley moved that we proceed to make the necessary repairs on the Building and grounds, including fence and trees and that a suitable loan for said purpose be made from the Banks, not exceeding ten thousand dollars at interest not exceeding ten per cent and that all work be let by contract where practicable.

Which motion prevailed.

The Secretary was instructed to wire B.W. Fish Architect to come at once examine the building, prepare plans and specifications for repairing the building and that bids for doing the work be submitted at the next meeting for consideration by the Board.

Mr Twamley moved that the Bill of W. Merrifield for $2400 for Brittanica [sic] be allowed and an order drawn for [written over on] the Library Fund which motion prevailed, all voting aye.

Mr Fulton moved that the bill of Prof. Montgomery of $1200 be allowed – that $1000 thereof for stamps be paid from the Incidental Fund and $2 for Specimens from the Museum Fund – which motion prevailed, all voting aye. Mr Twamley moved that negotiations for replacing the birds & animals be opened with Mr Story at Drayton and with the taxidermist at Reynolds, which motion prevailed. The applications of Misses Joy & Smith for positions as Teachers were on motion of Mr Fulton referred to the Faculty with the request that they report at the meeting of July 7th/ 87, which motion prevailed and on motion the Board adjourned to meet July 7th 1887.

The Board of Regents met pursuant to the call of the Executive Committee. Present Regents Fulton Heidel Twamley and Pres't Roach.

The minutes of the meetings of the Board held June 22nd & 28th were read and approved. The minutes of the Executive Committee for July 7 & 8 & 25. and August 5th were read and approved and the action of the Committee at each and all of said meetings was ratified and approved as the action of the Board.

Mr Fulton moved that Estimate for Dormitory as allowed by Executive Committee for the sum of $2248.68/100 Dollars be audited and allowed by this Board for a like amount which motion prevailed. all voting aye.

Also moved that the bill of A.Y. Fisk for Dormitory flaws for $200.00 be allowed and charged to "Dormitory Fund" which motion

Mr Heidel moved that the Estimate be allowed at the sum of $3072.84, which motion prevailed, all voting aye. and to voucher ordered drawn on the Dormitory Fund.

Mr Heidel moved that the Estimate be allowed for the sum of Five hundred ninety eight & 40/100 Dollars and that a voucher be drawn on the Special Repair Fund – which motion prevailed. All voting aye. Mr Fulton moved that the following Bills be allowed & vouchers be drawn on the Dormitory Fund.

Minneapolis Tribune.  Advertising Proposals $36.00

Times Record.   Do    Do.      $20.00

Fargo Argus.     Do.   Do.      $29.63.

Which motion prevailed, all voting aye.

Also moved that the Secretary correspond with Mr Cook and request him to deliver the "cuts" of the University and Dormitory in the regular way and after examination thereof and approval and acceptance by the Board of Regents the bill to be considered and allowed by the Board which motion prevailed, all voting aye.

Also, that Harry Beyer be allowed $100oo on his contract for papering and painting the Library & Regents' rooms, and that a voucher therefor [sic] be drawn on the Dormitory Fund, which motion prevailed, all voting aye.

August 16th 1887.

Thomas Hennessy presented the following communication.

Grand Forks, DT.

August 16th 1887.

To the Board of Regents of the)

University of North Dakota.)

Gentlemen.

I propose to furnish all materials and do all work according to the specifications submitted by me for Heating the Dormitory Building, now in course of erection near this City for the sum of Four thousand two hundred and fifty dollars. Further to supply all necessary coils for the Drying Room for Fifty dollars additional.

Mr Twamley moved that the contract for steam heating be awarded to Thomas Hennessy, including the coils needed in the Drying Room for the sum of Forty three hundred dollars, which motion prevailed, all voting aye. Mr Heidel moved that the Secretary of the Faculty be instructed to purchase the books for the Library recommended by the Faculty and approved by the Library Committee, where he can purchase them the cheapest, and the amount so expended shall not exceed Fifteen hundred dollars for this fiscal year which motion prevailed, all voting aye.

Mr Twamley moved that chairs be purchased for seating the Assembly Room, which motion prevailed. Mr Fulton moved that the purchase of chairs be referred to the chairmen respectively of the Building & Library Committee, which motion prevailed.

Also that the Agricultural Association be permitted to use the Dakota Exhibit during the Territorial Fair to be held at Grand Forks in September 1887, which motion prevailed

Informal Recess

The Committee on Chairs for the Assembly Room, reported the purchase of 150 chairs from Wm Budge. the chairs to be placed in proper shape in the Assembly Room, which purchase was approved. Also recommended that E.C. Richmond be allowed $2500 additional on his contract for Library cases, which recommendation was approved.

August 16th 1887.

Mr Twamley moved that the Secretary of the Faculty be instructed to win Prof John H. Hewitt of Williamstown Mass requesting him to visit Grand Forks, at our expense, for a conference with the Regents as to the Presidency of the University – which motion prevailed –

Also moved that the Bills of Wm Groves, Wilson Ray, John Case – JB Johnson and Adrian Labere for work on 16th June /87 at the University be laid on the table.

Mr Fulton moved that 800 cords of mill wood be purchased of the Red River Lumber Co. at $225 per cord delivered and that the Secretary enter into a written contract with the Company conditioned that 500# cords be slabs and 300 cords be "tied edging" which motion prevailed – all voting aye

Also moved. That the advertisement prepared by the Secretary of the Faculty be inserted in each of fifteen papers published in North Dakota the total expense not to exceed $300 for three months advertising. To be inserted in the following papers, viz Pembina Co Democrat Bathgate, Pembina Co. Grafton News & Times - Forest River Journal, Cavalier County Record, Devils Lake Inter-Ocean – Larimore Pioneer. Valley City Times-Record – North Dakota Farmer Methodist Pioneer, Educational News. Plaindealer, & Herald of Grand Forks. Fargo Argus. Bismarck Tribune. Hillsboro Banner The Bill of James Twamley of $42oo for traveling Expenses was on motion of Mr Heidel allowed & voucher ordered drawn on the General Fund, all voting aye.

September 5th 1887.

The Board of Regents met pursuant to the call of the President. Present Messrs Fulton, Donovan Heidel & Pres Roach. The minutes of the preceding meeting were read and approved.

The Secretary reported negotiations with T.B. Walker for furnishing the wood for University and that Mr Walker refused to contract at the price named viz $225 a cord for slabs and edgings

Mr Twamley moved that the purchase of wood be referred to the Executive Committee with power to act which motion prevailed.

The following estimate on the Special Repair Fund was presented & considered viz.

Dormitory fund which motion prevailed, all voting aye. The Secretary presented the record in the Board given for building the Observatory by Messrs Budge. Ohmer T M Kelory which on motion of Mr Twamley was referred to the Atty General to proceed to collect.

Mr Fulton moved that the bill of A.Y. Fisk of $10000 for plans & specifications be allowed and voucher drawn on the Special Repair Fund which motion prevailed, all voting aye. Also that the bill of Chat Lowry of $1000 be allowed & charged to the same fund which motion prevailed all voting aye. Communications from JH Smart & Prof John H. Hewitt as to the Presidency were read by the Secretary & filed. Mr Twamley moved that the Secretary of the Faculty visit the East & confer with Prof. Hewitt as to accepting the Presidency. His Expenses to be borne by the Board, which motion prevailed, all voting aye.

Recess until September 6th 1887.

            Bill of Prof Montgomery for $59.85 was allowed and a voucher ordered drawn on the Museum Fund.

Mr Fulton moved that the Bill of Plaindealer for $206.88 be allowed & vouchers drawn for $2000 on Incidental Fund. $35.58 on Dormitory Fund. $5.00 on Special Repair Fund & Balance on Incidental Fund which motion prevailed, all voting aye. Bills of Storey & Williams for $3100 & WH Browns for for [sic] $620 were allowed & vouchers ordered drawn on the Museum Fund, all voting aye. Mr Twamley moved that H.J. Marclay be appointed assistant Librarian at a salary of $10 per month – Library to be kept open three hours a day. From 3 to 5 for benefit of the public. Also another hour to be designated by the Faculty. which motion prevailed, all voting aye.

Mr Fulton moved that W.H. Topping be employed as instructor in Military tactics & gymnasium at a salary of $900 per year payable monthly. It is understood that Col Topping & family will reside in and take charge of the Dormitory building and board the resident students at a rate not to exceed $350 per head [inserted] each week which motion prevailed.

Mr Fulton moved the estimate be allowed & voucher drawn on the Dormitory fund. which motion prevailed all aye. Thos Hennessy presented a Steamheating Estimate of $2053.10 which on motion of Mr Fulton was allowed at the sum of $1642.48 and voucher ordered drawn on Dormitory Fund. all aye.

Bill of JA Baldwin for Freight & drayage of $15.50 was allowed & voucher ordered drawn on Museum fund all aye. The Bill of St Paul Globe for advertising. was allowed & voucher ordered drawn on the Dormitory Fund – all aye.

The Communication of Prof Merrifield from Boston as to the Presidency was read and ordered filed The application of Mr Peck from Manchester Eng for a Professor ship was ordered filed – Secretary to acknowledge receipt of the application.

Mr Fulton as Chairman of the Executive Committee reported that Mr White would deliver at the University 600 cords Green Wood @ $275 per cord & 200 cords Drywood at $325 a cord. Mr Twamley moved that the contract be let to Mr White as above motion prevailed

On motion of Mr Twamley the following bills were allowed and ordered charged to the respective funds.

C.E. Heidel $52.00 General Fund – [inserted] all aye JWH Cook. $3400 Incidental Fund – ayes 3 – Twamley nay. JG Hamilton. $36.75 Museum – all aye. Recess until Wednesday.

            Mr Heidel moved that the matter of furniture for the Dormitory be referred to the Executive Committee with power to act – that said Committee purchase a piano – motion prevailed – Twamley no.

            Board considered the Furniture question – The bill of H.R.[written over] Griffith was referred to Secretary to investigate and the Board took a recess subject to call of the President.

Grand Forks. D.T.

October 3rd 1887.

The Board met in regular adjourned Session pursuant to the call of the President and in accordance with the action of the Board at the September session.  Present Regents Donovan. Fulton, Heidel Twamley and Pres Roach.

In view of the letter of declination of Gilbert H. Pierce of the Presidency – the office of President was declared vacant and the question for consideration being the election of a President and the candidate Col Homer B. Sprague having arrived in Grand Forks upon invitation of the Board – it was moved that the Board proceed to the election of a President of the University, which motion prevailed – a Ballot being ordered  Col’ Homer B. Sprague received five ballots and he was declared unanimously the duly elected President of the University for the ensuing insert school year at a salary of $3000.00 per annum for the school year, including actual traveling expenses from Boston to Grand Forks.

Novr 2/87.

Pursuant to call the Board of Regents met at the Secretary’s Office.  Present.  Messrs, Fulton, Twamley, and President Roach.  No quorum being present the President declared the meeting adjourned.

Grand Forks D.T.

Decr 6th 1887.

The Board of Regents met at the Office of the Secretary.  Present Regents Fulton, Heidel, Twamley and Pres Roach.  The minutes of the preceding meetings read and approved.  The minutes of the Executive Committee of Novr 2nd /87 were adopted.  The contract of Wm Groves for staining the Main Building was considered and on motion of Mr Fulton $10000 was reserved from balance due to ensure the removal of the stain on the Stone work, and the sum of $45000 ordered paid out of the Special Repair Fund.  All voting aye.  Mr Twamley introduced the following resolution.  Resolved That the Salary of the Engineer and Janitor be fixed at the sum of $7500 per month during Novr Decr Jany Febry & March of each year respectively and at $6500 per month for the remaining months – This compensation to be paid until otherwise ordered by the Board – that the Engineer be allowed the sum of $2000 per month additional for an assistant Fireman during the months of Novr Decr Jany. Febry & March. which resolution was adopted.

The following bills were considered, audited and allowed and ordered charged to the respective funds named.  All voting aye.

Dear Sir:

Your favor of the 22nd ulto[-]stating that you had found objections to furnishing arms to the Students of our University, was duly rec’d.  It was such a matter of disappointment to me and the other members of the Board, that we have been to some trouble to read up the Section & Chapter referred to by you.  After a careful reading and construction by us, and others versed in the law, of the Chapter mentioned we are firmly convinced that the enactment means only to apply to individual cases, and the objection, so it seems to us, would only hold in the case of a loan, donation etc to an individual, private

School or Institution.  Ours being a Territorial Institution, in charge of duly appointed and qualified Officers, the application of this clause is of no force and effect, as to the loan, donation or storage of such Territorial property as is asked for.

Besides this, if you will pardon what may seem a presumption, I would respectfully call your attention to Section Eleven Chapter Forty, Session laws of 1883, the act establishing the University of North Dakota, wherein the furnishing arms to the Students is expressly provided for and made the duty of the Territory.

I am extremely anxious in this matter, because the student company is now well organized and inspired with a good deal of proper enthusiasm for the work, to which, the possession of arms and accouterments, will add materially.

Trusting you will pardon my seeming persisting and that your objections will not weigh so heavily after reading this.

Dear Sir.

Yours of the 1st at hand, contents noted.  I must differ with you on construction of Sec 67 of Chap 100 (Militia law).  But I agree with you that under Sect 11 of Chapter 40 of laws of 1883, the arms can be furnished, and will with pleasure let you have them.  I was not aware of that Section – Never fail to write me fully whenever you feel inclined, I am only too glad to be set right when in error, and always pleased to be aided in all matters that concern the public welfare.
